1.SERVICES PROVIDED

a. We will prepare for your firm a professionally designed website from a style chosen from our collection. Your Website will comprise all the pages shown in the Mortgage Intermediaries demonstration sites illustrated within this website
Specifically:

Your firm's logo will prominently feature throughout the site
Your business name and contact details will be included at the foot of each main subject page
Your firm’s personalised introduction for the ‘about us’ page will be included
Your firm's terms of business will be included if applicable
Mortgage Sourcing and Insurance quotations with online applications will be added to your site
Your company name and contact numbers at the foot of each main subject page
All changes required for compliance.

b. As part of our service, we will keep your website up to date to reflect essential changes in legislation, calculator details etc. The amount and frequency of the updating will be at our discretion and will be made at no extra cost to you.

Please note that the final content of your site might differ slightly from that shown in the demonstration sites, for technical reasons, or to keep its content current.

2. OUR CHARGES

We will charge you a set-up fee of £175.00 plus a monthly administration fee of £69.95 plus vat payable by standing order.

Cancellation of standing order for any reason other than termination of contract with Legal and Financial will incurr a penalty equivalent to £25 reinstatement fee and 2% above base rate per week on outstanding balances.

Standing Order commencement:

First collection will be no earlier than 7 days after the first draft of your site has been uploaded for you to review

Please note:

As stated above, our charges commence once you can see your draft site, not upon its ultimate finalization, as we have no control over the speed with which your site is reviewed and compliance checked. However, we aim to make any minor or compliance changes to the draft site within 7 days of being given details.

Your site will not be made accessible to the public until you and your compliance department or Network has approved it and you have instructed us to make it "live".

If, after you have reviewed your draft site, you wish us to make minor changes, these will be made at no extra charge to you; more major changes (excluding those for compliance purposes - see below) might, at our discretion, be chargeable to you; however, if this situation arises we will agree costs and payment terms with you before carrying out the work.

Amendments required for compliance purposes will be made at no additional cost to you.

For accounting purposes, invoices will be issued quarterly in arrears for your fees.


Optional upgrades

Optional website feature upgrades will be offered to you from time to time, some of which may be available at a supplementary charge. Details of costs will be provided when we inform you of the upgrades.

Changes to the monthly fee

We reserve the right to increase our monthly fee upon giving you a minimum of 60 days' notice in writing. However, no increase will be sought within 12 months from the date of your first standing order payment.

Charges for additional work on your website

When specific requests are made for further customisation to your website, we will provide you with a quotation in advance. Subject to the size of the project we may request a deposit upon commencement of work, with balance payable on completion.

Balances are payable 7 days after completion of work. Late payment will incurr a late payment fee of 2% above base rate per week on outstanding balances.

3. E-MAIL

Your Site comes with three POP3 e-mail addresses. We will provide you with information to allow you to configure your e-mail software, but we cannot do it for you. Please consult with your in-house IT department or local computer engineer if further assistance is required to configure your email. Additional email addresses area available at £3.75 + vat per month per address


4. SEARCH ENGINES/DIRECTORIES


a. All relevant site pages include "meta tags" to assist in search engine listing, and these will be tailored by us to reflect the name and location of your business.
b. Once completed, your site will initially be promoted to the major search engines/directories which provide free listings. We shall then regularly re-submit your website to maintain its presence in the main search engines


5. DOMAIN NAME

a. If required, and at no cost to you, we will register your chosen domain name for you (you will be the owner.)
b. You will be responsible for payment of all subsequent renewal fees.
c. If you decide to transfer your domain to another service, any costs incurred by us will be recharged to you at cost plus a 10% administration fee.
d. If you already have a domain name you wish to use, we will assist in its transfer as necessary. We will make no extra charge, but sometimes the registrar with which you have registered your domain may require a transfer fee, which is payable by your firm.
Please note: There is no reduction in the monthly administration fee if you already have your own domain name.

6. WEB HOSTING

a. If required, we will arrange for your website to be hosted with our commercial web host, and the cost of this service is covered in your monthly fee.
b. If you prefer to use your own hosting service, please let us know and we shall ask you for the information necessary in order for us to upload your site to the web. However, some hosting companies may not fully support the technical requirements of our websites; in this event, we may recommend the full use of our own hosting services, included in our monthly administration fee - there will be no extra charge to you.
Please note: There is no reduction in the monthly fee if you choose to use your own host.
Company's Liability

In no circumstances whatsoever will the company be liable for economic, indirect or consequential loss arising from delays or service interruptions

The company will not be responsible for loss occasioned by computer viruses, whether introduced by the Company's software or otherwise

We the company shall not be held liable for any loss or damage caused by the use, misuse, unavailability or removal of services
Whilst the company shall expeditiously seek domain registration, the company shall not be liable in the event of the domain having been registered by some other person by the time the company seeks registration in which event a full refund will be paid to the client without any other liability on the part of the company for loss by the client

To protect your privacy we conform with the requirements of the Data Protection Act, 1998, we will not distribute your name or e-mail address to any third party. We do not send random marketing emails to personal email addresses.

7. AMENDING, UPGRADING AND FURTHER CUSTOMISING YOUR SITE

a. We will make or add, at no charge:
• changes to contact details
• updates as specified in 1b above
• articles or information provided by you for inclusion on the "News & Updates" page, provided these are supplied to us complete and in electronic format
b. Other additions or customization will be charged for on a time basis, but we will agree costs and payment terms with you before carrying out the work. Your site can be upgraded at any time in the future to include:
• Additional pages
• New graphics
• Specific links to other sites

8. COMPLIANCE

a. Your firm is responsible at all times for ensuring that the site, and any changes to it, are compliant.

b. Your firm is responsible for keeping a copy of your site, and details of all changes to it, for compliance purposes. We will normally retain only a copy of the most current version of your site, but will supply you with a copy of that on CD upon request.

c. The way in which Network compliance departments wish to view websites varies. Some will look at it on-line and may print it out, some will require the site on CD, others may ask you for a full site print-out. Please note that if required, we shall be pleased to prepare a CD for you to forward to them; however, site print-outs are your responsibility.

ANTICIPATED TURNAROUND TIME ON ALL REQUESTED PROJECTS WILL BE ADVISED ONCE INSTRUCTIONS HAVE BEEN RECEIVED.

9.CONTENT PROVIDED BY THIRD PARTIES


Your website will contain information, and may link to services, provided by third parties. We will accept no liability for any losses or damages incurred by you or your clients from the use or non-availability of such content.

10. YOUR RIGHT TO CANCEL

You may cancel this arrangement at any time after a minimum period of 12 months, by providing us with one month's notice in writing.

11. COPYRIGHT

The content of these websites, including all text and images, unless provided by you or a third party, is the property of Legal & Financial. If you cease to use our service you may not use any part of the site (except that provided by you or a third party) on any other website.

Any site modifications, textual or graphics, will be arranged on request, and in some circumstances may be chargeable. We do not allow access to our sites to external parties. Any work you commission for your site by external suppliers must be submitted to us for approval submission to your compliance department and upload
